Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Wickt mobile application and website (collectively, the “Service”) operated by Wickt (“we”, “us”, or “our”). By downloading the app, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Nature of the Service

Wickt is a social gaming platform that allows registered users to make picks for cricket matches and compete with friends in private groups and public leaderboards. The Service is operated in India and governed by Indian law.

Wickt is expressly not:

• A platform where match results create external financial benefits.
• A roster-building sports platform.
• A service based on odds or financial-risk mechanics.
• A platform offering external financial benefits of any description.

All Wickt group activity is conducted purely for entertainment, bragging rights, and social engagement. Payments only unlock app features.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age to purchase the season pass or make any in-app payment.
• Be capable of forming a legally binding contract under Indian law.
• Not be prohibited from using the Service under the laws of your state or country of residence.

By using the Service, you represent and warrant that you meet all eligibility requirements. If you are under 18 and wish to purchase the season pass, you must obtain consent from a parent or legal guardian, who will be responsible for the transaction.

3. Account Registration

To access most features of Wickt, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials confidential and not share them with any third party.
• Notify us immediately at support@wickt.in if you suspect unauthorised access to your account.
• Take responsibility for all activity that occurs under your account.

You may register using a valid email address or through Google Sign-In. One person may maintain only one active account. Creating multiple accounts is prohibited and may result in termination of all associated accounts.

4. Season Pass

4.1 What the season pass is

Wickt offers an optional season pass at a one-time payment of ₹249. The season pass unlocks premium features including, but not limited to, enhanced leaderboard views, extended group management tools, and access to exclusive season-long app experiences.

4.2 Payment

Payments are processed securely via Razorpay and are subject to Razorpay’s terms of service. By making a payment, you authorise us to charge the stated amount to your selected payment method.

4.3 Feature access only

The season pass grants access to features only. It does not constitute an entry fee into any external reward program and does not create any right outside the app features described in these Terms.

4.4 Refund policy

The season pass is a digital product and payments are generally non-refundable once the pass has been activated and features have been accessed. If you believe you have been charged in error, please contact us at support@wickt.in within 7 days of the transaction and we will review your case.

5. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Post, share, or transmit any content that is abusive, harassing, threatening, defamatory, obscene, hateful, or discriminatory on the basis of religion, caste, gender, race, nationality, sexual orientation, or disability.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorised access to any part of the Service, other user accounts, or our infrastructure.
• Use automated scripts, bots, or scrapers to access or interact with the Service.
• Manipulate picks, leaderboards, or group standings through any deceptive or fraudulent means.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any commercial purpose without our prior written consent.
• Violate any applicable local, state, national, or international law or regulation.

6. User-Generated Content

The Service may allow you to submit content including usernames, avatars, group names, and messages. By submitting content, you:

• Represent that you own or have the right to use and share the content.
• Grant Wickt a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content solely in connection with operating the Service.
• Agree that your content does not violate the conduct rules in Section 5 or any applicable law.

We reserve the right to remove any content that we, in our sole discretion, consider to be in violation of these Terms or otherwise objectionable, without notice to you.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the Wickt name, logo, design, text, graphics, and software — are the exclusive property of Wickt and are protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written permission.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Match data, scores, or pick results will always be accurate or up to date.
• Any defects or errors in the Service will be corrected in a timely manner.

We are not responsible for the accuracy of third-party cricket data or scores used in the Service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Wickt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service. Our total aggregate liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹249, whichever is greater.

10. Account Termination

10.1 Termination by you

You may delete your account at any time by using the in-app account deletion feature or by emailing us at support@wickt.in. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

10.2 Termination by us

We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have:

• Violated any provision of these Terms.
• Engaged in conduct that we reasonably believe is harmful to other users, third parties, or the Service.
• Provided false or misleading information during registration.
• Created multiple accounts to circumvent a suspension or restriction.

In cases of serious violations (including hate speech, harassment, or fraud), termination will be immediate and permanent. For lesser violations, we may issue a warning before taking action.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

Before initiating any legal proceedings, we encourage you to contact us at support@wickt.in to attempt to resolve the matter informally. We will make a genuine effort to resolve disputes through mutual discussion.

12. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will notify you via the app or by email with at least 14 days’ notice before the new terms take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service before the effective date.

13. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wickt regarding the Service.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign ours without restriction.
